a. The function and communication of our service are dependent on the data of our users. Personal data is particularly sensitive - this refers to all information that can be clearly traced back to a specific natural person. According to the GDPR, we are obliged to list the full scope of all such data.

We assure you that this data is used exclusively for the functioning and implementation of the order process, statistical evaluation, personalised advertising and marketing communications and the improvement of our offer. We only collect, use and pass on your personal data if this is permitted by law, is carried out within the Group or if you consent to the collection of data. In accordance with applicable regulations, this data is only collected for the time you use our service. We also reserve the right to check the server log files retrospectively if there are concrete indications of unlawful use. The legally applicable deletion regulations are complied with.

Your personal data is protected by technical and organisational security measures in order to minimise risks in connection with its loss, misuse, unlawful access and unauthorised disclosure.

b. In principle, we process your personal data that you provide to us as part of your application. We treat all information you send us as application data, including your CV, your photo and all other details and information.

This data processing as part of the application process is carried out on the basis of Art. 6 para. 1 lit. b) GDPR, § 26 para. 1 sentence 1 BDSG. Insofar as special categories of personal data are processed in accordance with Art. 9 para. 1 GDPR, this serves the exercise of rights or the fulfilment of legal obligations under labour law, social security law and social protection law (e.g. informing the representative body for severely disabled persons in accordance with § 81 SGB IX) as part of the application procedure. This is done on the basis of Art. 9 para. 2 lit. b) GDPR in conjunction with. § Section 26 para. 3 BDSG. The transmission of a photo is voluntary.


After completion of the applicant selection process, we will retain your application documents for a further 6 months on the basis of our overriding legitimate interest (Art. 6 para. 1 lit. f) GDPR) and then delete them or destroy any copies, unless we have concluded an employment contract with you. 


3. Payment processing in the Marinepool companies online shop

Your bank and payment details (credit card details), which you enter when purchasing in the Marinepool online shop, are neither collected nor processed or stored on the IT systems of the Marinepool companies. Payments are processed exclusively on IT systems and under the technical and legal responsibility of our respective payment service providers. In the run-up to the payment process, a credit check may also be carried out by the respective payment service provider, over the results of which we have no influence. Consignment tracking - Consent to the forwarding of the e-mail address to postal service providers for delivery and consignment tracking

By confirming the privacy policy in the online shop, you consent to the forwarding of your e-mail address to the postal service providers for tracking purposes. They use this to offer you shipment tracking of your order and to keep you informed about the whereabouts of your ordered goods and the exact time of delivery.

 

4. Data transmission/data logging

4.1 Log files

A log file is created as part of an automatic log of the processing computer system. This means that information from the end device you use is stored as log files on a server.

We also carry out a log file analysis. Our website provider logs the following:

Access to the page: date, time, frequency

How you reached the page (previous page, hyperlink, etc.)

Amount of data sent

Which browser and which version of it you are using

(Your) IP address used

Here too, the data collected is only used to improve our website. The operator may only store server log files for longer, release them or subsequently access and check them if this is permitted within the legal framework (e.g. in the event of suspected illegal activities).


4.2 Duration of data storage 

We store your data for as long as required for the respective purpose:

- Offer/enquiry data: 1 year (feedback from customer/prospective customer)

- Contract documents: 10 years

- IP data: 3 years (regular limitation period)

If there is a retention period under tax law for certain data processed for the processing of sales contracts (document data), the retention period is 6 or 10 years. During this time, the processing of the data is restricted. The retention obligation begins at the end of the calendar year in which the offer was made or the contract was fulfilled. 

 

4.3 Cookies

Cookies enable us in particular to determine the frequency of use and number of users of the pages, to analyse the behaviour of page use, but also to make our offer more customer-friendly. 5. Web analysis services

This website uses Google Analytics 4 - hereinafter GA 4 -, a web analysis service of Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, (‘Google’). Google Analytics uses so-called ‘cookies’, scripts and pixels that are stored on your computer and enable your use of the website to be analysed. In addition, your usage behaviour is recorded to a large extent by means of AI and machine learning by accessing your end device. The information generated about your use of this website is usually transmitted to a Google server in the USA and stored there.
However, if IP anonymisation is activated on this website, your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area beforehand and automatically preset. You have the right to withdraw your consent to the collection of data at any time. This right applies with effect for the future; the data collected until the revocation becomes legally effective remains unaffected by this.

7.2 Right to data portability

You have the right to request the transfer of your data from us to another organisation. 

7.3 Right to authorisation, deletion or blocking

The personal data specified in the contract, in particular name, address, telephone number, bank details, which are necessary and required solely for the purpose of implementing the resulting contractual relationship, are collected on the basis of legal authorisations.
